Terms of Use

This site contains a searchable database of research projects in which AOHC member centres have participated.  This database is accessible to member centres and the general public and is intended to be an easily accessible tool to assist in the development of research projects or for individuals who are attempting to integrate research into practice.  AOHC is only responsible for maintaining and hosting this site.  Research and other information available on this site may be posted by users of the site.  AOHC shall not in any way be liable for any information or documents posted by such users.

The information and services available through this site are subject to the following terms and conditions ("Terms of Use").  AOHC may revise these Terms of Use at any time without prior notice. By accessing and using this site, you agree to be bound by the then current version of these Terms of Use and all applicable laws.  If you do not agree to be bound by these Terms of Use, do not further access or use this site.   AOHC recommends that you review these Terms of Use each time you access the Site.

1. Use of the Site. You may access and use the site for your personal, non-commercial use, provided that you do so only in accordance with these Terms of Use.

2. Submitted Information. Any material or information that you post, input, upload, provide, submit or transmit to the site (the "Submitted Information") will be treated as non-confidential information.  You assume full responsibility and liability for any Submitted Information and represent and warrant that you have all necessary rights, consents and licenses, as applicable, with respect to the Submitted Information.  You hereby grant AOHC and other users of the site a royalty-free, perpetual, non-exclusive, irrevocable license to use, copy, communicate and distribute the Submitted Information or any derivative of such information.  AOHC does not control any Submitted Information, therefore, you should not consider any such information to be screened, approved or endorsed by AOHC.  Users are advised to thoroughly review and edit all information before posting it to this site to ensure it does not include any information that may permit the identification of an individual.  While it has no obligation to do so, AOHC may, in its sole discretion, monitor the site and Submitted Information from time to time and edit, refuse to post or remove any information or materials that, in its view, do not adhere to these Terms of Use.

3. Ownership of Site and Content.  The site and all written and other materials made available through the site, excluding Submitted Information, (the "Content") is the property of AOHC and/or its licensors and may be protected by copyright, trade-mark and other laws.  Without prejudice to the rights of third party licensors and to the extent permitted by law, AOHC hereby grants you permission to copy, distribute, download, and/or transmit single copies of items comprising of Content of the site for your personal, non-commercial use, provided that you maintain all copyright and other notices that may be contained in such Content, and provided that such permission does not include the right to reproduce the Site as a whole (or a substantial part thereof).  No other right or license to the Site or the Content is hereby granted.

5. Third-Party Links.  For your convenience, AOHC may provide links to websites that are owned or operated by third parties.  Such sites are independent from AOHC and AOHC has no control over the content of such third-party sites.  A link to a third-party’s site does not imply that the AOHC endorses the site, approves the contents of the site or guarantees the accuracy or timeliness of such third-party information.  It is your responsibility to ensure that you review the terms and conditions applicable to such third-party site before using it.

6. Disclaimer and Limitation of Liability. This site and the Content are provided on an "as is" and "as available" basis.  AOHC makes no representations, conditions or warranties either express or implied, that (i) the site, its Content and Submitted Information will be accurate, current or reliable; (ii) the operation of the site will be uninterrupted or error-free, or (iii) the site will always be free from viruses or harmful components.  AOHC hereby disclaims any warranties or conditions arising by law, statute, trade usage or otherwise, including without limitation warranties and conditions of merchantability, fitness for a particular purpose, non-infringement or title.  In no event will AOHC, its directors, officers, employees, agents or licensors be liable to you or any third party for damages of any kind incurred in connection with your use of the site.

7. Indemnity. You agree to defend, indemnify and hold the AOHC, its directors, officers, employees, agents and licensors harmless from any and all liabilities, costs and expenses related to, or in connection with, your Submitted Information, your use of this Site, the Contents and Submitted Information and any violation of these Terms of Use by you.

8. Governing Law.  These Terms of Use and any issue or dispute relating to this site shall be governed by and be construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada.  By using this Site you agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario.

9. General Provisions.  Failure by AOHC to insist upon or enforce strict performance of any provision of these Terms of Use shall not be construed as a waiver of any provision or right.  If any of the provisions of these Terms of Use are deemed to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein.
